1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you" or "User") and NMAKI SG Pte Ltd ("Company," "we," "us," or "our"), concerning your access to and use of the Cashew website located athttps://www.cashew.sg, as well as any other media form, media channel, mobile website, mobile application related, linked, or otherwise connected thereto (collectively, the "Platform") and the services offered thereon (the "Services").

Our Privacy Policy, located athttps://www.cashew.sg/privacy, is incorporated by reference into these Terms and also governs your use of the Services.

2. Description of Services

Cashew is an online platform that provides users with information, comparison tools, and a means to connect with and apply for mortgage products offered by third-party financial institutions and lenders ("Lenders"). Our services are online, AI-supported mortgage brokerage services.

Our Services may include:

  • Providing general information and educational content about mortgages.
  • Allowing you to compare mortgage products based on information provided by Lenders or publicly available, supported by AI algorithms.
  • Facilitating the submission of your mortgage application and supporting documents to Lenders you select.
  • Offering AI-driven insights and suggestions to assist you in your mortgage journey.
  • Acting as a mortgage broker to assist you in finding and applying for suitable mortgage products.

IMPORTANT DISCLAIMERS:

  • We are NOT a Lender: All loans are made by third-party Lenders.
  • We do NOT provide Financial, Legal, or Tax Advice: Information is for general purposes only and should not be treated as professional advice.
  • No Guarantee of Loan Approval or Specific Terms: Loan decisions are made by Lenders and are subject to their discretion.
  • Information Accuracy: We strive for accuracy but do not guarantee completeness or timeliness.
  • AI Limitations: Our AI is advisory in nature and not a substitute for human decision-making.

3. Eligibility and User Accounts

Eligibility:

You must be at least 18 years of age and a resident of Singapore or otherwise legally capable of entering into binding contracts.

Account Registration:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Keep your password secure and accept risks of unauthorized access.
  • Notify us immediately of any security breaches.

You are responsible for all activity under your account.

4. User Obligations and Conduct

You agree not to:

  • Provide false or misleading information.
  • Use Services for illegal purposes.
  • Impersonate another person or misrepresent affiliations.
  • Disrupt or interfere with the Platform or networks.
  • Attempt unauthorized access to systems or accounts.
  • Upload malicious code or software.
  • Scrape or harvest data without consent.
  • Violate applicable laws including those on data protection and finance.

5. Intellectual Property Rights

All Platform content is owned or licensed by NMAKI SG Pte Ltd. You are granted a limited license to use the Platform for personal, non-commercial use. Do not copy, modify, distribute, reverse engineer, or create derivative works unless explicitly permitted.

6. Third-Party Links and Services

We are not responsible for the practices or content of linked third-party sites. Your interactions with these sites are at your own risk.

7. Fees and Payments

  • We do not charge users for brokerage services.
  • We receive equal commissions from Lenders to ensure impartiality.
  • Users are responsible for any fees charged directly by Lenders.

8. Disclaimers of Warranties

The Platform and Services are provided “as is.” We do not guarantee uninterrupted or error-free service, nor do we guarantee accuracy, reliability, or outcomes of AI-generated data.

9. Limitation of Liability

We are not liable for indirect, incidental, or consequential damages. Our total liability is limited to SGD 100. Some limitations may not apply depending on jurisdiction.

10. Indemnification

You agree to indemnify us from any claims arising from your use of the Platform, violation of these Terms, or reliance on any content including AI-generated content.

11. Termination

  • You may close your account at any time.
  • We may suspend or terminate your access at our discretion.
  • Rights and obligations that should survive termination will do so.

12. Governing Law and Dispute Resolution

These Terms are governed by Singapore law.

Disputes should first be mediated via the Singapore Mediation Centre. If unresolved within 60 days, they may be submitted to the Singapore courts.

13. Modifications to Terms

We may revise these Terms. For material changes, we will provide 30 days’ notice. Continued use constitutes acceptance.

14. General Provisions

  • These Terms and our Privacy Policy form the entire agreement.
  • If any provision is invalid, others remain enforceable.
  • Failure to enforce rights does not waive them.
  • You may not assign these Terms; we may assign freely.
  • We may notify you via email or the Platform.
  • Headings are for convenience only.
